2. Definitions
- Company: Refers to Profuture Tech Solutions Private Limited, Chennai.
- Software: Refers to CloudxERP Corporate Suite, including all modules (Project, Account, HRM, CRM, POS).
- User: Any individual, business, or entity that accesses or uses CloudxERP.
- Services: Includes all features, updates, support, and integrations provided with CloudxERP.
3. Use of CloudxERP
3.1 Eligibility
You must be 18 years or older to use CloudxERP. By using our services, you confirm that you have the legal authority to agree to these terms.
3.2 License
Profuture Tech Solutions Private Limited grants you a non-exclusive, non-transferable, revocable license to use CloudxERP for your business operations, subject to compliance with these terms.
3.3 Restrictions
Users must not:
- Share, distribute, or resell the software without authorization.
- Modify, reverse-engineer, or create derivative works of CloudxERP.
- Use the software for unlawful or fraudulent activities.
- Attempt to breach or compromise the security of the system.
4. Subion & Payment
- 4.1 Pricing: CloudxERP is available on a subion-based model with different plans. The pricing details are available on our website.
- 4.2 Payment Terms: Payments must be made in advance based on the selected plan. Late payments may result in account suspension.
- 4.3 Refunds: We offer a 7-day refund policy for new subions. After this period, no refunds will be issued.
5. Data Privacy & Security
- We collect and store user data securely in compliance with applicable laws.
- Users are responsible for maintaining the confidentiality of their account credentials.
- We implement industry-standard security measures, but we are not liable for data loss due to unauthorized access, hacking, or third-party breaches.
6. Support & Maintenance
- We provide regular updates, bug fixes, and security patches to ensure smooth operations.
- Support services are available via email, chat, and call based on the subion plan.
- Downtime may occur due to maintenance, and we strive to notify users in advance.
7. Intellectual Property
- All content, trademarks, and software code associated with CloudxERP remain the intellectual property of Profuture Tech Solutions Private Limited.
- Users are granted a license to use the software, but ownership remains with the company.
8. Termination & Suspension
- We reserve the right to suspend or terminate accounts that violate these terms.
- Users may cancel their subion anytime, but refunds will not be provided after the refund period.
9. Limitation of Liability
- Profuture Tech Solutions Private Limited is not liable for indirect, incidental, or consequential damages arising from the use of CloudxERP.
- Our maximum liability is limited to the amount paid by the user in the last three months.
10. Governing Law & Dispute Resolution
- These terms are governed by the laws of India.
- Any disputes must be settled through arbitration in Chennai, Tamil Nadu.
11. Modifications to Terms
- We reserve the right to update or modify these terms at any time.
- Continued use of CloudxERP after changes means acceptance of the new terms.
